The transfer followed Pemberton's absence in the case's preliminary investigation procedure, which was scheduled yesterday.

The US Marine was instead represented by his lawyer Rowena Flores. The subpoena issued "by the investigating prosecutor did not compel the appearance of the American serviceman", Flores argued.

"I would like to avail of the 10 days to study the case and the various documents submitted by the complainant", Flores added.

On Wednesday, the U.S. Military turned over Marine Private First Class Joseph Scott Pemberton to the Philippine military's main camp.

It was an agreement between the U.S. and the Philippines, Philippine National Police chief of staff Gen. Gregorio Pio Catapang said in a press conference.

Pemberton was transported to Manila early Wednesday on board a helicopter.

The case of Joseph Scott Pemberton over an alleged killing of Jeffrey “Jennifer” Laude has been a serious element in the current talks on Visiting Forces Agreement (VFA), which has already been in effect between the US and Philippine government.
